Terms & Conditions
These are the terms & conditions applicable to the use of this website.
Business entity
APE, APE Performance Electronics, APE Electronics and the domain names ape-electronics.eu and ape-electronics.be are owned by the business entity Bankei BV, BE0845.003.721, based in Leuven, Belgium.
You can contact us via the contact form on this website or via reachout@ape-electronics.eu.
Usage of the webshop
By using this webshop and website, you agree to these terms & conditions and the privacy policy.
All prices are shown without VAT. VAT is calculated based on your location, so you’ll pay Belgian VAT in Belgium, or another country’s VAT if you’re in the EU. If you are an EU business outside of Belgium, or you are outside of the EU, then VAT free transactions may be possible.
On top of the price of the goods, there can be additional costs for shipping, handling, and whatever other costs that apply. These will be clearly stated in the final calculation of the total cost.
Adding goods to a shopping cart does not imply any guarantee of getting these goods. It’s not a business transaction.
Back-orders are allowed when we expect a quick delivery from the supplier. Typically, we will allow this when we expect the goods to arrive in around one week. So you should get them delivered to you in about two weeks, depending on your location and shipment operators.
When you purchase goods, there are a number of reasons that can stop us from fulfilling your order. These include, but are not limited to:
- Product out of stock. Somebody else beat you to it and ordered the last unit! This item will then turn into a back-order.
- Back-order delays. Our supplier is unable to ship the item within the expected time. We will communicate to you and you will get the choice to cancel the item or to wait for it.
- Force majeure. This term indicates anything that is out of our control, like suppliers going bankrupt, disasters on our side or the side of our suppliers, or anything else that cannot be predicted.
In any situation where we are unable to deliver the purchased goods, the amount of the undelivered goods will be reimbursed.
Responsibilities as a customer
You are responsible to provide the right shipment address that corresponds with the country in which your taxes are due. You are also responsible to provide the right shipment address, so typing mistakes that result in lost packages will not be compensated for. You are also responsible to provide correct payment information. Payments are always at the time of purchase and via the webshop. No credit or delay of payment in any form will be given. No payment means no transaction. You are also responsible for any customs and duties applied to your purchase.
Shipment, warranty and returns
Shipment is calculated at check-out, together with the applicable taxes. If you are a business, shipment risk is on you. Free shipment can be granted based on the total amount of the transaction, based on a coupon, or for other reasons. A previous free shipment does not entitle you to free shipment again: conditions may change without notice. I am not responsible for delays caused by the shipment company.
Cancelling an order is possible before a shipping label was created. You will be reimbursed for the full amount. However, when a shipping label was already created, you will not be reimbursed for the shipment fee. If the goods were shipped when you cancel, this will turn into a return request described below.
Assembled products have standard European warranty conditions, so 2 years against faulty units. We will take up contact with the manufacturer to arrange a solution to the problem. In most cases, this will be a replacement by a working unit, though in specific cases the manufacturer may repair the product. Faulty units that are caused by external factors (e.g. by the shipping company or by delivery at the customer premises) are not covered by this warranty. Please communicate to us in detail what has happened so we can investigate and take the necessary steps to solve the problem.
The warranty does not apply to DIY products because of the nature of DIY. Once you apply any tool (screw driver, soldering iron, …) to a product, warranty is void. If you buy a DIY product from us and you run into problems, contact us with details of your purchase and your problem. We will help you on a best-effort basis within reasonable limits. If however you notice parts of a DIY kit missing, contact us with the necessary documentation and descriptions and we will work with the supplier to get this fixed.
You also have 14 days to return the product. This applies only when the goods are in perfect condition. For assembled units, this includes no rack rash, no wear on knobs or jacks, no bent pins, and no functional issues. For DIY, this means that the package is unopened. In any case, the reimbursement may be reduced with a restocking fee, import taxes or other import costs, or a B-stock deduction in case the item is in less than perfect condition. Surprises can be avoided by contacting us before sending in the return.
In any of these cases – first communicate with us. Only ship us something when we’ve explicitly asked you to do so.
Law
All interactions are governed by Belgian law. Bankei BV is based in Leuven. But please contact me first so we can find a solution in case of problems.
If any section of these terms & conditions turns out to be not applicable, this does not impact the remainder of the document.
